Slip/Trip/Fall Premises Liability Cases

Falls are the second leading cause of unintentional injury deaths worldwide. In 2022 alone, over 45,000 people died as a result of a fall. Falls cause 8 million emergency room visits in the United States each year. Slips and trips account for over 1 million fall injuries annually.

In Washington State, 31% of adults over the age of 65 experienced a fall and 49% of injury-related deaths were caused by a fall. In 2020, nearly 30,000 emergency department visits for adults 60 and over were due to a fall.

The tragic part of these fall statistics is that most falls are caused by dangerous conditions created by humans. Many falls are caused by a lack of attention to well-established safety practices. In fact, there are standards for safe walking surfaces. However, to save money, store and property owners and others choose not to follow these standard. Instead, they blame the customer when a fall occurs.

A slip/trip and fall caused by a careless store owner or property owner is one type of premises liability case. A dog bite case is another type of premises liability case.

In Washington State, notice of a dangerous condition is critical in order to prove your slip/trip and fall case. Photos, videos and witness testimony can be helpful in proving that the owner had notice of the dangerous condition and did nothing to make it safe.

If you or a loved one suffered a serious injury due to a slip or a trip and fall at a store, retail location or property outside your home, we can help you recover. Most property/home owners have insurance that cover these types of injuries. Property owners, hotel operators, parking lot operators, retail stores and others who own or manage a property have a duty to maintain safe walking surfaces for those who visit their properties. Whether you slipped in a grocery store, tripped in a parking lot, fell at a hotel or rental, we will aggressively pursue full compensation.

Wrongful Death and Catastrophic Injury Cases

Wrongful Death is a type of legal case where a family member or representative of a loved one’s estate pursues financial losses and compensation against the individual and/or corporation that caused the death. A catastrophic injury case involves injuries so severe that the injured survivor and her/his family will require life-long medical treatment in order to live with the injuries. Cases involving a traumatic brain injury or spinal cord injury require highly experienced and respected medical professionals, life care planning professionals, vocational rehabilitation experts, and economists in order to ensure that the injured survivor and her/his family have the financial resources available to make life as easy as possible.

At Foster Law Offices, we represent families in wrongful death claims, survivors of sexual abuse and violent crimes, and victims of extreme personal injury cases. Whether your loved one was lost due to an auto accident, slip/trip and fall, criminal act, or corporate negligence, we provide compassionate and aggressive legal advocacy to hold those responsible accountable and pursue the compensation due to the survivor and her/his family. We understand the emotional and financial toll losing a loved one can have on a family and the physical, emotional and financial toll a catastrophic injury can have on the survivor.

Frequently Asked Questions

After seeking immediate medical attention, it’s important to document the accident and your injuries as thoroughly as possible. This includes taking photos, collecting contact information for any witnesses, and keeping detailed records of your medical treatment and expenses. Contacting an experienced personal injury attorney early on can also help protect your rights and ensure you receive the full compensation you’re entitled to.

Generally, to have a valid personal injury claim, you must have suffered an injury due to the negligence or wrongful conduct of another party. This could include car accidents, slip and fall incidents, defective products, and more. An attorney can review the specific details of your case and advise you on whether you have grounds to pursue a claim.

Depending on the circumstances of your case, you may be able to recover compensation for medical expenses, lost wages, property damage, pain and suffering, and other damages. An attorney can help calculate the full extent of your losses and fight to get you the maximum settlement or award.

In Washington state, the statute of limitations for most personal injury claims is 3 years from the date of the accident or injury. It’s important to act quickly, as failing to file your claim within this time frame could prevent you from recovering any compensation.

Not necessarily. Many personal injury cases are settled out of court through negotiations with the insurance company. However, if a fair settlement cannot be reached, your attorney may recommend filing a lawsuit and taking the case to trial. They will work closely with you to determine the best legal strategy for your unique situation.
